You should be able to get your own agent as long as you haven't signed an agreement with the listing agent to represent you. You should be up front with the listing agent and let her?know that you have someone else you want to work with.?You're spending a lot of money and at the end of the day, you should feel comfortable with who's in your corner.

I would put something in writing to the listing agent so that you have a record of it. And I would let the new agent know the situation because the listing agent could fight the new agent for the commission.??

It all really depends on the rules of procuring cause in NY.?The question?will be if the listing agent can show procuring cause - that?she was the one?who brought the property to your attention - then the agent may still have a right to the commission.?In?California, procuring cause?doesn't?exist any more, but I don't know about the state of New York.?Your new agent should be able to mitigate this for you.
