When Steve Shaffer decided to get out of the tech world and fulfill a long-held dream of owning his own winery, he and his wife, Marilee, figured they'd have to relocate to one of the usual suspects: Napa, Sonoma, the Sierra foothills ? one of those places where the vineyards seem to roll on forever, the air always smells like grapes, and everyone else in town is also in the wine business. But they'd lived in the country before, and the more they thought about it, Shaffer said, "the more we realized, it's beautiful, it's bucolic ? but it's boring." The two ended up founding their winery, Urban Legend, in a nondescript brick warehouse on a quiet stretch of Fourth Street in Oakland's Jack London district, and they've never looked back.

"It just makes so much more sense to put a winery out here than in the country," Shaffer said. "In terms of your carbon footprint, in terms of the variety of grapes you're getting, it's just a good idea." Here, the Shaffers are closer to their client base, closer to their home, closer to the people who can repair their machinery. They get to know their customers and their customers get to know them ? even if a lot of those customers find them by accident. "I think a lot of people are surprised to find a winery here," he said. "And they're even more surprised when I say there are about a dozen in town."

According to Kevin Brown, co-owner of Alameda's R&B Cellars and president of the East Bay Vintner's Alliance, there are at least 25 wineries in the urban East Bay. In fact, though comprehensive statistics are mutable and hard to come by, we're in the middle of what's often said to be the densest urban commercial winemaking environment in the country. And with the exception of some early adopters like Alameda's Rosenblum Cellars, which was founded in 1978, the vast majority of these have sprung up in recent years.

They're part of a long history: For about forty years starting in the 1880s, the Bay Area was home to some of the biggest winemakers in the nation ? first in downtown San Francisco, before the 1906 earthquake, and then in Point Richmond, which was, between the earthquake and Prohibition, home to the largest winery in the world, Winehaven.

It wasn't until the Seventies that the California winemaking industry came to be so rooted in Napa and Sonoma, and that was mostly for reasons of a back-to-the-land philosophy than because of any practical competitive advantage, said Brendan Eliason, owner of Oakland's Periscope Cellars and, as it turns out, a bit of a wine-history buff. In fact, he said, in many ways, rural areas are poorly suited to industrial wine production.

"Those are great areas to grow grapes in, but the truth is, they're awful to make wine in," he said. And he would know; he spent ten years working as a winemaker in northern Sonoma County before opening Periscope. "They are small, rural towns. The electricity sucks. The access to water sucks. The wastewater management sucks. The size of the roads for trucks sucks. You're out in the middle of nowhere with no easy access to supplies or anything else like that. If you look at the current political battles in Napa and Sonoma especially, but really Mendocino and Paso Robles and any major wine region in California, it's a tale of minimal resources. ... You have hundreds of wineries fighting over these meager resources and they're really only meager because you're in the wrong spot."

There's a reason wineries have historically set up shop in cities, Eliason argued, and there's a reason they're coming back. "If you really want good infrastructure for making wine, we're sitting in it," he said. "A lot of people have only just started to realize it, but there are so many benefits to making wine here."

Economics, for one. "It's a lot cheaper," Bob Rawson of Urbano Cellars said, laughing, when I asked him why he decided to found his winery in Berkeley.

The electricity, access to water, and other infrastructure Eliason mentioned cost money, after all ? and according to Shaffer, the cost (not to mention the carbon footprint) of trucking fully prepared and packaged bottles of wine is significantly greater than the cost of shipping the raw grapes and bottling the wine closer to consumers.

"Glass is much heavier than people realize," Eliason noted.

In Berkeley, Rawson, said, "Basically, all we need is a warehouse space that either has or can put in a minimal amount of infrastructure."

Even as the wine industry has continued to be hit hard by the recession and its aftershocks, property values in Sonoma and Napa counties have, by and large, continued to rise precipitously, to the degree that it's all but impossible for a small-scale entrepreneur ? a Shaffer or an Eliason or a Rawson ? to even get in the game. The city, on the other hand, has far fewer barriers to entry ? and those savings often get passed onto the consumer. "There is the romance of the vineyards and the oak-paneled tasting room and the guest cottage and all that," he said. "But at an urban winery, the money you're spending is being [put] toward what's in the bottle. It's going to the steak and not to the sizzle."

That's not necessarily to say that the East Bay's urban wines are always cheaper: According to David Sharp of Temescal wine shop The Wine Mine, in terms of economies of scale, sometimes low overhead can get canceled out by a tiny yield. But they do offer a particular bang for one's buck. Because small, urban wineries don't own the land on which the grapes they use are grown, opting to contract out with vineyards (some on a short-term basis, others for seasons at a time, and with varying degrees of control and input over the harvesting process) they usually have a bit more control over their wines. And because the Bay Area is located where it is, the East Bay's urban vintners have access to grapes from both Northern and Central California.

"Being small like we are avoids the bigger wineries' problems of making everything grow well on a single plot of land," said Adam Love of Two Mile Wines. That means Two Mile gets its grapes wherever they grow best ? Sangiovese from Dry Creek, Petite Syrah from Livermore, Viogner from the Central Coast ? and is freer to experiment with certain regions, grapes, and types of wine. "You do find a little bit more variety, since they aren't growing the grapes themselves," Sharp added. There's certainly a range, he noted, but "they can make some very, very good wines."

Perhaps unsurprisingly, Brown, of the East Bay Vintner's Alliance agrees: "These are some world-class wineries," he said, referring to the alliance's membership. "It's not just some funky offshoot. You're talking very high-caliber producers."

Customers, by the way, seem to agree. Though margins in the wine industry have always been slim, all the winemakers I spoke to said business was good. In many ways, that should come as no surprise: The urban winemaking movement fits in well with both the artisan and locavore movements, two larger trends that hit around the same time as urban winemaking and have lodged themselves firmly into the East Bay's eating and drinking culture. As people ? especially people around here ? continue to think of grocery shopping as a political act, to question the value of food that's mass-produced and shipped in from afar, and to be interested in who, not what, is making what they're eating, it makes sense that they'd also begin doing that with their wine.

"If you drink a bottle of my wine, you probably bought it from me," Eliason said. "I like that, and my customers like that." Further, he said, as the wine industry grows up, wine-drinkers in general are becoming more open to vintners and labels that don't necessarily fit a preconceived notion of what a winery is or should be. "American wine culture is still very young," he said. "Many people still just associate a big fancy chateau with good wine, but I really think that's changing. We will continue to grow." And in the meantime, he's very happy where he is.

(AP) ? A conservative super PAC affiliated with Republican strategist Karl Rove has jumped back into the Indiana Senate race with a nearly $1 million ad buy highlighting Democratic nominee Joe Donnelly's support for President Barack Obama's policies.

The Indiana buy is part of more than $6.4 million worth of air time that Crossroads GPS and American Crossroads bought this week against Democrats in six competitive Senate contests, according to Federal Election Commission records. The money was also dedicated to Senate races in Florida, Ohio, Virginia, Nevada and Wisconsin.

Indiana, while appearing firmly in GOP presidential nominee Mitt Romney's camp, is emerging as a battleground state for control of the Senate. Groups supporting Democrats also have poured about $1.5 million into the race in the past six weeks, hoping to take away the seat held for 36 years by Republican Richard Lugar.

State Treasurer Richard Mourdock defeated Lugar in the Republican primary in May and was an early favorite to keep the seat in GOP hands.

Crossroads GPS makes the case that Donnelly, now a House member, cast critical votes in support of Obama's $833 billion economic stimulus and expansion of government-supported health insurance coverage. It's the first time the group has been on the state's airwaves in more than three months.

"So why would Donnelly vote any different if we gave him a promotion?" the ad's narrator asks.

The theme of the ad is commonplace in states where Romney is expected to win in the Nov. 6 presidential election.

Donnelly has said he supports changing what Republicans derisively call "Obamacare," as well as extending Bush-era income tax cuts for all households, including those earning more than $250,000 annually. Obama says those households should pay more.

"Indiana voters are rejecting Mourdock's 'my way or the highway' attitude, so a smear campaign from secret donors is the only other option," said Donnelly's campaign manager, Paul Tencher.

In Florida, American Crossroads appealed to the state's elderly population with a $1.8 million ad buy focused on changes to Medicare that were made in the health care bill. The ad claims that Democratic Sen. Bill Nelson cast the deciding vote for the bill, which it said cuts Medicare spending and puts an unelected board in charge of coverage decisions.

Republicans have not shied away from the Medicare issue in this year's House and Senate races.

Democrats are focusing their Medicare ads on a proposal by Rep. Paul Ryan, the GOP vice presidential nominee, that would change the program for those under 55 from a fee-for-service program to one in which beneficiaries use a government subsidy to help buy insurance coverage. Meanwhile, Republicans are focusing criticism on the spending cuts called for in the Democratic-led health overhaul. Those cuts were directed at private insurers and hospitals.

In Virginia, the Crossroads ads highlight former Gov. Tim Kaine's comment during a debate that he could support making more people pay federal income taxes.

The group also focused on taxes in criticizing Sen. Sherrod Brown of Ohio, Rep. Shelley Berkley of Nevada and Rep. Tammy Baldwin of Wisconsin.

Italy's Monti says he would consider heading government again

NEW YORK (Reuters) - Italy's technocrat Prime Minister Mario Monti gave the first clear indication on Thursday that he would be willing to head the government again if there is no outright winner in elections next year, as opinion polls now suggest.

Monti has headed an unelected government since former premier Silvio Berlusconi stepped down in November, imposing austerity reforms to keep the country from a Greek-style debt debacle.

Financial markets have been fretting over what government might succeed the Monti administration as Italy's political parties - discredited by their mismanagement of the economy and a long series of corruption scandals - are in disarray seven months before the election.

"I hope there will be a clear result with a clear possibility for whatever majority to be formed and for a government led by a political leader," Monti said during a briefing at the Council on Foreign Relations in New York.

"Should there be circumstances in which they were to believe that I could serve helpfully after that period of elections, I will be there, I will consider, I cannot preclude anything."

Business leaders and European officials have said they would like to see Monti continue leading Italy so that the reform process is not turned back, but most of Italy's parties are already campaigning against the tax increases and pension cuts he has made.

The yield on Italian benchmark bonds fell after Monti made the remarks, with the spread against safer Germany bunds narrowing to around 3.68 percentage points from around 3.76 points earlier in the day.

Nicholas Spiro, head of Spiro Sovereign Strategy, said Monti's stance would be "music to the ears of investors and is likely to underpin the recent improvement in Italy's perceived creditworthiness".

At an auction earlier on Thursday Italian 10-year bond yields fell to 5.2 percent from 5.8 percent at the previous sale, while yields on 5-year borrowing declined to 4.1 percent, the lowest since May 2011.

OPPOSITION

Political reaction among opposition groups in parliament was less favorable, with several members saying Monti should be a candidate in the election if he wanted to carry on as premier.

"He should run for office like in a normal democracy and put an end to short cuts that mean he only represents himself and his friends," said Felice Belisario of the opposition People of Values party.

The 69-year-old Monti repeated that he would not stand in the national vote because it would destabilize the right-left coalition that now supports him. But Monti does not need to be elected to qualify to become prime minister because he was appointed a senator for life last year.

It is still not clear who the candidates for the two biggest parties will be, and even the voting law may be changed before April, the deadline for the election.

If the current election system is used, polls suggest the centre-left Democratic Party (PD) and its allies would win the lower house, but in the upper house, or Senate, the result would be unclear. That would require another right-left alliance like the one that now backs Monti in parliament, or a whole new vote.

Monti, a former economist and European commissioner, continues to be Italy's most popular politician. His approval rating was 42 percent in mid-September, compared with 26 percent for PD leader Pier Luigi Bersani, an opinion poll showed last week.

Berlusconi, who leads the largest centre-right party, had an approval rating of 18 percent, and Beppe Grillo, the comedian who heads the new Five-Star Movement, had a 25 percent rating.

During the same talk, Monti said that Greece's exit from the euro zone would cause "damage to the whole system" and that he does not think it will happen.

In Ohio, Romney says his "heart aches" for jobless

WESTERVILLE, Ohio (Reuters) - Republican presidential candidate Mitt Romney expressed empathy for unemployed Americans on Wednesday in what appeared to be an effort to repair the damage from comments he made in a leaked videotape that has sent his poll numbers on a downward slide.

"I've been across the country. My heart aches for the people I've seen," Romney told an enthusiastic crowd in Westerville on the second day of a bus tour across a state considered a must-win for him in the November 6 election.

On a day the candidate was joined by golf legend and Ohio native Jack Nicklaus, a new poll by Quinnipiac University and The New York Times spelled trouble for Romney.

It said that Democratic President Barack Obama - who also campaigned in Ohio on Wednesday - leads Romney in Ohio by 10 percentage points and is ahead in two other important states - Florida and Pennsylvania - by similar margins.

Ohio and Florida are politically divided states central to Romney's hopes to amass the 270 electoral votes needed for victory, and losing either could be disastrous for the Republican.

The survey suggested that Romney, who was trailing Obama by a smaller margin at the beginning of last week, has been significantly damaged by the disclosure of a secretly taped video of him speaking at a private fundraiser in May.

In the video, Romney - a former private equity executive with a fortune estimated at up to $250 million - tells wealthy donors to his campaign that 47 percent of Americans are "victims" who depend on government, don't pay federal income taxes and are unlikely to support him.

The airing of the comments last week sent Romney's campaign into crisis mode. Democrats were quick to point out that the "47 percent" to whom Romney referred - those who receive some form of government benefits - includes not just the poor but also working-class families, members of the military and the elderly, some of whom Romney has depended upon for support.

"The furor over his 47 percent remark almost certainly is a major factor in the roughly double-digit leads President Barack Obama has in Florida, Ohio and Pennsylvania," said Peter A. Brown, assistant director of the Quinnipiac University Polling Institute.

The Reuters/Ipsos daily tracking poll on Wednesday had Obama essentially maintaining the lead he built over Romney last week among likely voters nationwide, 49 percent to 43 percent.

'SO MANY PEOPLE ... HURTING'

Romney often talks about the people he meets while campaigning, but he usually does so to illustrate a story about a successful business - a man who made sandwiches in his garage and grew his company into a national chain, a woman who makes furniture for hospital waiting rooms.

On Wednesday, Romney took a different tack, and told stories of economic hardship that he linked to Obama's stewardship of a sluggish economy.

Ohio is a relatively challenging place for Romney's economic message. The state unemployment rate is 7.2 percent, below the national rate of 8.1 percent.

One in eight jobs in Ohio is linked to the automobile industry, and Obama's campaign has been reminding Ohio residents that he pushed through the industry bailout, and Romney opposed it.

"I was yesterday with a woman who was emotional and she said, ?Look, I've been out of work since May.' She was in her 50s. She said, ?I don't see any prospects. Can you help me?' " Romney said.

"There are so many people in our country that are hurting right now," Romney added. "I want to help them. I know what it takes to get an economy going again and creating jobs."

The Romney campaign amplified this message with a new television ad featuring the candidate speaking directly into the camera.

"President Obama and I both care about poor and middle-class families," Romney says in the ad. "The difference is, my policies will make things better for them. We shouldn't measure compassion by how many people are on welfare."

In his Westerville speech, Romney fought back against claims by Obama's campaign that Romney's proposed across-the-board 20 percent tax cut would mostly benefit the wealthy. Romney also said he would limit some tax deductions.

"By the way, don't be expecting a huge cut in taxes because I'm also going to be closing loopholes on deductions," he said.

Nicklaus added some star power to Romney's appearance. The golf great likened the election of Obama in 2008 to an errant shot. Golfers can't fret over a bad shot but must move on, he said.

"America cannot afford four more years of Barack Obama's failed policies," Nicklaus said. "We need a real recovery."

Romney campaigned in Ohio with Paul Ryan, his vice presidential running mate, on Tuesday. It was their first appearance together in more than three weeks, as aides promised a more aggressive phase of campaigning after Romney spent much of the past two weeks raising money and holding few public rallies.

Ryan campaigned on Wednesday in Colorado, another battleground state where polls show Romney in a tight race with Obama.

LEXINGTON, Ky. (Sept. 26, 2012) A study by a team of University of Kentucky researchers has shed new light on the potential habit-forming properties of the popular pain medication tramadol, in research funded by the National Institute on Drug Abuse. The paper is slated to appear in an upcoming edition of the academic journal Psychopharmacology.

Prescription pain killer abuse is a major public health problem in the U.S. In 2010, more individuals over the age of 12 reported nonmedical use of prescription pain relievers in the past month than use of cocaine, methamphetamine or heroin.

"Prescription pain pill abuse is a real problem in Kentucky. We have lots of overdoses. We held a summit here in February specifically about partnering law enforcement and medicine to tackle this problem," said lead study author William W. Stoops of the UK College of Medicine Department of Behavioral Science, the UK Center on Drug and Alcohol Research (CDAR) and the UK College of Arts and Sciences Department of Psychology.

Other UK authors include: Michelle R. Lofwall, Paul A. Nuzzo, Lori B. Craig, Anthony J. Siegel and Sharon L. Walsh.

The study utilized a double-blind, placebo-controlled design. Participants were given one of 12 possible dose combinations of placebo, tramadol, naltrexone and hydromorphone. Naltrexone is an opioid receptor blocker, used to attenuate the effects of opioid medications. Following drug administration, participants were evaluated based on self-reported measures, observer-reported measures, ocular measurements (such as pupil dilation) and performance tasks. Ten participants completed the study.

It was expected that if both tramadol and hydromorphone (Dilaudid), a common opioid analgesic, acted similarly upon the nervous system, administering naltrexone would mitigate the effects of both drugs in a similar fashion. What was found was that while participants given both hydromorphone and naltrexone reported a lack of influence by the drug, patients taking tramadol and naltrexone reported still feeling "high". Participants who received hydropmorphone or tramadol with placebo also reported feeling affected.

"When we've given them placebo and the opioid receptors are not blocked, tramadol and hydromorphone produce fairly similar effects," said Stoops. "They make subjects say that they're high, they make subjects say that they like the drug, those kind of things. Tramadol does produce some bad effects; folks are saying that it makes them a little nauseous so it is a little distinct from hydromorphone in that manner, which is important. When we gave folks naltrexone, when we blocked those opioid receptors, hydromorphone didn't produce any effects, it was like we'd given them placebo. It completely blocked the effects of hydromorphone because the primary way hydromorphone works is on the opioid receptors in the brain; they're blocked so of course hydoromorphone isn't going to produce an effect. With tramadol, we did not see anywhere near the blockaded effect that we saw with hydromorphone. We need to test a higher naltrexone dose to confirm that this is the case."

The overall results of the study indicated that on measures such as "liking" and "street value," participants rated tramadol highly, suggesting an increased potential for abuse. However, in order to reach these favorable ratings, participants had to take doses well above the normal therapeutic range, and into a range which also produced several negative side effects such as gastrointestinal illness, vomiting and feeling unwell.

LEXINGTON, Ky. (Sept. 26, 2012) A study by a team of University of Kentucky researchers has shed new light on the potential habit-forming properties of the popular pain medication tramadol, in research funded by the National Institute on Drug Abuse. The paper is slated to appear in an upcoming edition of the academic journal Psychopharmacology.

Prescription pain killer abuse is a major public health problem in the U.S. In 2010, more individuals over the age of 12 reported nonmedical use of prescription pain relievers in the past month than use of cocaine, methamphetamine or heroin.

"Prescription pain pill abuse is a real problem in Kentucky. We have lots of overdoses. We held a summit here in February specifically about partnering law enforcement and medicine to tackle this problem," said lead study author William W. Stoops of the UK College of Medicine Department of Behavioral Science, the UK Center on Drug and Alcohol Research (CDAR) and the UK College of Arts and Sciences Department of Psychology.

Other UK authors include: Michelle R. Lofwall, Paul A. Nuzzo, Lori B. Craig, Anthony J. Siegel and Sharon L. Walsh.

The study utilized a double-blind, placebo-controlled design. Participants were given one of 12 possible dose combinations of placebo, tramadol, naltrexone and hydromorphone. Naltrexone is an opioid receptor blocker, used to attenuate the effects of opioid medications. Following drug administration, participants were evaluated based on self-reported measures, observer-reported measures, ocular measurements (such as pupil dilation) and performance tasks. Ten participants completed the study.

It was expected that if both tramadol and hydromorphone (Dilaudid), a common opioid analgesic, acted similarly upon the nervous system, administering naltrexone would mitigate the effects of both drugs in a similar fashion. What was found was that while participants given both hydromorphone and naltrexone reported a lack of influence by the drug, patients taking tramadol and naltrexone reported still feeling "high". Participants who received hydropmorphone or tramadol with placebo also reported feeling affected.

"When we've given them placebo and the opioid receptors are not blocked, tramadol and hydromorphone produce fairly similar effects," said Stoops. "They make subjects say that they're high, they make subjects say that they like the drug, those kind of things. Tramadol does produce some bad effects; folks are saying that it makes them a little nauseous so it is a little distinct from hydromorphone in that manner, which is important. When we gave folks naltrexone, when we blocked those opioid receptors, hydromorphone didn't produce any effects, it was like we'd given them placebo. It completely blocked the effects of hydromorphone because the primary way hydromorphone works is on the opioid receptors in the brain; they're blocked so of course hydoromorphone isn't going to produce an effect. With tramadol, we did not see anywhere near the blockaded effect that we saw with hydromorphone. We need to test a higher naltrexone dose to confirm that this is the case."

The overall results of the study indicated that on measures such as "liking" and "street value," participants rated tramadol highly, suggesting an increased potential for abuse. However, in order to reach these favorable ratings, participants had to take doses well above the normal therapeutic range, and into a range which also produced several negative side effects such as gastrointestinal illness, vomiting and feeling unwell.

Gut microbes help the body extract more calories from food

ScienceDaily (Sep. 12, 2012) ? You may think you have your food all to yourself, but you're actually sharing it with a vast community of microbes waiting within your digestive tract. A new study from the University of North Carolina School of Medicine reveals some gut microbes increase the absorption of dietary fats, allowing the host organism to extract more calories from the same amount of food.

"This study is the first to demonstrate that microbes can promote the absorption of dietary fats in the intestine and their subsequent metabolism in the body," said senior study author John Rawls, PhD, associate professor in the Department of Cell and Molecular Physiology at UNC. "The results underscore the complex relationship between microbes, diet and host physiology."

Previous studies showed gut microbes aid in the breakdown of complex carbohydrates, but their role in dietary fat metabolism remained a mystery, until now. The research was published in the Sept 13, 2012 issue of the journal Cell Host & Microbe.

The study was carried out in zebrafish, which are optically transparent when young. By feeding the fish fatty acids tagged with fluorescent dye, the researchers were able to directly observe the absorption and transport of fats in the presence or absence of gut microbes.

The researchers pinpointed one group of bacteria -- Firmicutes -- as instrumental in increasing fat absorption. They also found the abundance of Firmicutes in the gut was influenced by diet: fish fed normally had more Firmicutes bacteria compared to fish that were denied food for several days. Other studies have linked a higher relative abundance of Firmicutes in the gut with obesity in humans.

"Our findings indicate that the gut microbiota can increase the host's ability to harvest calories from the diet by stimulating fat absorption," said the study's lead researcher, Ivana Semova, PhD, who was a graduate student at UNC at the time the study was conducted. "Another implication is that diet history could impact fat absorption by changing the abundance of certain microbes, such as Firmicutes, that promote fat absorption."

Although the study involved only fish, not humans, the researchers say it offers insights that could help inform new approaches to treating obesity and other disorders. For example, said Rawls, "If we can understand how specific gut bacteria are able to stimulate absorption of dietary fat, we may be able to use that information to develop new ways to reduce fat absorption in the context of obesity and associated metabolic diseases, and to enhance fat absorption in the context of malnutrition."

Study co-authors include Lantz Mackey of UNC, Juliana Carten and Steven Farber of the Carnegie Institution for Science, and Jesse Stombaugh and Rob Knight of the University of Colorado at Boulder.

Samsung Sells 20 Million Galaxy S III Units in 100 Days

We already knew that Samsung's flagship Galaxy S III smartphone is uber-popular, but now the phone maker has revealed just how fast the device has been selling.

Samsung on Thursday said it has sold 20 million Galaxy S III units in just over three months. That makes the Galaxy S III Samsung's most successful smartphone to date, generating sales quicker than any of its predecessors.

"The Galaxy S III has enjoyed tremendous attention and popularity since its launch in May, and we are thrilled with its success," JK Shin, president and head of Samsung's IT and mobile communications division, said in a statement. "I would like to express my sincere appreciation to customers who have chosen the Galaxy S III. We will never stop providing the latest smart mobile technologies to help users live a life extraordinary."

Samsung back in July reached its lofty sales goal for the Galaxy S III, shipping 10 million units in less than two months. That translated to about 190,000 Galaxy S III smartphones being sold every day.

It's a bit difficult to compare these sales numbers to other devices, but last year, Apple sold more than four million iPhone 4S smartphones in its first three days; Nokia sold about 4 million Lumia devices during the entire second quarter.

The company late last month introduced the Galaxy S III in several new mineral and gemstone-themed colors that are perfect for fall. The new colors include "amber brown," "garnet red," "sapphire black," and "titanium grey."

The Galaxy S III boasts a 4.8-inch Super AMOLED 1,280-by-720 display, and runs Android 4.0 Ice Cream Sandwich. It features an 8-megapixel rear-facing camera and 1.9-megapixel front-facing one. Earlier this year, Samsung bested Nokia as the top phone maker in the world for the first time in 14 years.

Police in legal minefield on Ariz. immigration law

PHOENIX (AP) ? The most contentious part of Arizona's immigration law finally has approval to move forward, surviving a U.S. Supreme Court ruling, a heated national debate and two years of state politics.

But the practical effect of what critics call the "show me your papers" provision remains to be seen.

Immigrants are worried they'll be harassed by officers emboldened to pull them over because they look Hispanic.

Officers ? who will be required to ask people they encounter while enforcing other laws to show they're in the county legally if they find them suspicious ? say they'll be open to lawsuits if they're accused of racially profiling, or if they're accused of not adequately enforcing the law.

"It leaves us in a very, very, very, extremely gray area," Pima County Sheriff Clarence Dupnik said Thursday. "So now we get sued when we do profile, and we get sued if we don't profile."

Yet, it may be difficult to see the results.

Parts of the law, passed by a Republican-controlled Legislature and signed by Republican Gov. Jan Brewer in 2010, have been in effect for months but largely ignored ? mostly because they seem to address problems that don't exist, immigrant rights advocates say.

Dan Pochoda, the American Civil Liberties Union of Arizona's legal director, said the parts of the law already in effect "have had virtually no impact." He added that "we haven't even heard of any attempts to use" the other provisions.

Those sections of the law known as SB1070 include a ban on the adoption of so-called sanctuary city policies. The rule is aimed at preventing local government officials from deciding to pick and choose which federal immigration policies to enforce and which to ignore. There have been no reported violations in the state.

Another provision says that state and local agencies can't have a ban on sharing information, and therefore must cooperate in determining whether a person is a legal citizen eligible for public benefits.

Two other sections were viewed as minor changes to existing laws.

None has had any noticeable impact on how police go about their jobs.

The newly approved section of the law could be difficult to enforce, too.

Police will be required to check the status of people they encounter even investigating minor infractions, such as noise complaints. But federal immigration officials have said repeatedly they are focused on serious or repeat offenders. And the Supreme Court said local officials can't make immigration arrests or detain immigrants for too long on the side of the road.

Maricopa County Sheriff Joe Arpaio, who has been one of the nation's most high-profile supporters of strict border policy, said he's most worried that law enforcement won't be able to use the new provisions. He's concerned that U.S. Immigration and Customs Enforcement officials won't support his sheriff's deputies.

"What good is it for my guys to stop people, call ICE like we always do, and ICE says, 'We're not coming,'" Arpaio asked. "It's going to be very interesting to see what happens."

Tucson Police Chief Roberto Villasenor said his officers will comply with the law and contact federal officials when they encounter illegal immigrants, even though he thinks it will rarely result in an arrest.

"It's almost like an exercise in futility at this point, but under the law we are still required to contact them," he said.

But immigrant rights advocates predict that U.S. citizens will be illegally detained, and that Hispanics will be disproportionately affected.

Alessandra Soler, executive director of the ACLU of Arizona, said her organization will be scrutinizing cases to be sure police don't abuse the new rule, saying that "there have been numerous sheriffs who have said they will detain people for as long as is necessary to confirm their status. The Supreme Court has already said that is out of bounds."

More than anything, it will have a chilling effect on law enforcement interaction with Hispanics, opponents say.

Santa Cruz County Sheriff Tony Estrada that said such anxiety within immigrant communities will create problems for officers who have "worked very hard with community policing" and earned trust among people "regardless of their race or ethnicity or gender or economic or social situations."

He added that such fear "may be a problem. That may be an issue for law enforcement dealing with victims of crime."

The provision is expected to go into effect in about 10 days, once U.S. District Judge Susan Bolton, who affirmed the rule with her decision Wednesday, finalizes her order.

Judge slams military efforts to limit GITMO detainee access to lawyers

A federal judge used tough language to block efforts by the Obama administration to limit the legal rights of terror suspects held at the GuantanamoBay military prison inCuba, ruling Thursday that proposed changes were an "illegitimate exercise of executive power."

Officials of the departments of Justice and Defense had claimed they alone should decide when the prisoners deserve regular access to their attorneys.

But in a 32-page ruling, Judge Royce Lamberth said federal courts had proper authority to decide the matter, and criticized the executive branch for recently changing the procedures, when he said the current system was working well.

"The old maxim 'if it ain't broke, don't fix it' would seem to caution against altering a counsel-access regime that has proven safe, efficient, and eminently workable," said Lamberth. "Indeed," he added, "the government had no answer when the court posed this question in oral arguments" last month.

"Access to the courts means nothing without access to counsel," added the judge.

Justice Department lawyers said they have started restricting when Guantanamo prisoners could challenge their detention in the Washington-based federal court. If approved, any relaxing of the rules would be made on a case-by-case basis at the exclusive discretion of military officials, not by the courts.

At issue is whether a Supreme Court decision on detainee rights from 2008 gives federal courts the ultimate power to control so-called "habeas" petitions from foreign combatants in U.S. military custody. Volunteer private lawyers say they deserve regular access to their imprisoned clients, even if there is no active habeas challenge pending in court, or any pending charges.

Under the proposed changes, the Navy base commander at Guantanamo would have sole veto power over attorney access, as well as access to classified material, including information provided directly by the detainees from interrogations.

"The dispute thus before the court, though important, is quite narrow," said the government in its earlier legal filing. "The only question presented is whether detainees who have neither current nor impending habeas petitions are entitled to" challenge continued access to counsel. "The answer to that question is 'no.'"

Lamberth's Washington-based federal court has been handling the many appeals filed by the prisoners. There are currently 168 detainees - all male - in the Guantanamo facility, most of whom do not have pending charges. Five Muslim men labeled "high-value detainees" are being prosecuted before a military commission for their alleged leadership roles in the 9/11 terrorist attacks.

In the so-called Boumediene ruling in 2008, the high court said "enemy combatants" held overseas in U.S. military custody have a right to a "meaningful review" of their detention in the civilian legal justice system. It would force the government to present evidence and justify keeping the prisoners indefinitely, without charges. But a federal appeals court in Washington has since refused to order the release of any detainee filing a habeas corpus writ, in some cases rejecting such orders from lower-court judges.

Civil rights groups applauded the court opinion.

"The court has correctly recognized the government's attempt to restrict attorney access to the men at Guantanamo as the latest in a ten year history of successive efforts to "delay, hinder, or prevent access to the courts," said Vincent Warren, executive director of the Center for Constitutional Rights, which has been representing many of the Gitmo prisoners. "The new rules came out of the blue and can only be seen as an effort to punish the men at Guantanamo for exercising their right to challenge their detention. These rules would have given the government unfettered control over Guantanamo. As the court said, the executive cannot be trusted with such power."

The administration has argued it does not seek to restrict lawyers who have an active legal appeal, but that the rights of detainees shrink once they have filed their first habeas challenge. The military says lawyers must now agree to the new conditions in order to have continued access to their clients and to any classified information the military would deem to release.

And lawyers would be prohibited from using any information they gather that might help the prisoners appearing before a Periodic Review Board. Review boards are newly designed panels of military officials to decide whether a Guantanamo inmate should continue to be held, and whether that person is a national security threat.

Those boards were put in place by President Barack Obama by executive order, but have not been fully implemented.

"Executive Order 13,567 does not provide detainees who undergo PRB review with a judicially enforceable right to counsel, or any justification for asking the Court to impose a counsel-access regime on the PRB process other than the one developed, per the Order's direction, by the Secretary of Defense," said the government. "As a general matter, executive orders are viewed as management tools for implementing the President's policies, not as legally binding documents that may be enforced against the Executive Branch."

The government said the court's power to intervene was limited, and had urged Judge Lamberth to deny the request guaranteeing attorney access. But in strong language the judge refused.

"The court has an obligation to assure that those seeking to challenge their executive detention by petitioning for habeas relief have adequate, effective and meaningful access to the courts," said Lamberth. "And it is undisputed that petitioners here have a continuing right to seek habeas relief. It follows that petitioners have an ongoing right to access the courts and, necessarily, to consult with counsel. Therefore, the Government's attempt to supersede the court's authority is an illegitimate exercise of executive power.

"The court, whose duty it is to secure an individual's liberty from unauthorized and illegal Executive confinement, cannot now tell a prisoner that he must beg leave of the executive's grace before the court will involve itself. This very notion offends the separation-of-powers principles and our constitutional scheme."

The Justice Department now has the option of asking a federal appeals court to intervene.

The case is In re: Guantanamo Bay Detainee Continued Access to Counsel (1:04-cv-1254).

CHARLOTTE, North Carolina (CNN) ? President Barack Obama offers a better path forward for the country that will promote united values rather than the winner-takes-all mentality of Republicans, former President Bill Clinton told the Democratic National Convention on Wednesday night.

In a highly anticipated speech that formally nominated Obama for a second term, the two-term Democratic president framed the November election as a choice by voters of what kind of country they want.

?If you want a winner-take-all, you?re-on-your-own society, you should support the Republican ticket,? Clinton said. ?If you want a country of shared prosperity and shared responsibility ? a we?re-all-in-this-together society ? you should vote for Barack Obama and Joe Biden.?

With Obama inside the packed Times Warner Cable Arena in his first appearance at the convention that started Tuesday, Clinton responded to the attack line by Republican nominee Mitt Romney that Obama?s policies made things worse. Noting the economic crises Obama inherited on taking office in January 2009, Clinton declared to raucous cheers: ?No president ? not me, not any of my predecessors ? no one could have fully repaired all the damage that he found in just four years.?

He noted that ?a lot of Americans are still angry and frustrated by this economy? adding that ?too many people do not feel it yet.?

?I had the same thing happen in early ?94 and ?95,? Clinton said, drawing a parallel between his experience and Obama?s presidency. ?We could see it was working that the economy was growing, but people just couldn?t see it yet.?

Referring to last week?s GOP convention, Clinton said that ?in Tampa, the Republican argument against the president?s re-election was actually pretty simple, pretty snappy. It went something like this: ?We left him a total mess, he hasn?t finished cleaning it up yet, so fire him and put us back in.??

?I like the argument for President Obama?s re-election a lot better,? Clinton said. ?He inherited a deeply damaged economy, put a floor under the crash, began the long hard road to recovery, and laid the foundation for a more modern, more well-balanced economy that will produce millions of good new jobs, vibrant new businesses, and lots of new wealth for the innovators.?

Democratic economic policies have proven successful in the past, Clinton said, noting that Democratic administrations created 42 million jobs in their 24 years in power since 1961, compared to 24 million by GOP administrations in the other 28 years.

?It turns out advancing equal opportunity and economic empowerment is both morally right and economically sound,? Clinton continued.

Alluding to the rough primary campaign in 2008 when Obama defeated Clinton?s wife, Hillary, for the Democratic nomination, the former president said Obama showed his willingness to work with anyone by appointing her as his secretary of state and also including Republicans in his Cabinet as secretaries of defense and transportation.

Clinton also listed Obama?s achievements, focusing in particular on the 2010 health care reform law that he said has lowered health care costs and provided benefits for consumers such as allowing parents to keep children up to age 26 on family policies and preventing insurers from denying coverage for children due to pre-existing conditions.

?We?re better off because President Obama fought for health care reform,? Clinton declared, ?You bet we are.?

At the same time, Clinton criticized Republican proposals to overhaul the Medicare and Medicaid government health care programs for senior citizens, the poor and disabled.

?If that happens, I don?t know what those families are going to do,? he said. ?We can?t let that happen.?

Clinton also derided Republican deficit reduction plans, saying ?the numbers don?t add up? because of planned tax cuts without any new revenue sources. The result will be widespread spending cuts that hurt ?the middle class? and other vulnerable segments of society.

?Don?t you ever forget when you hear them talking about this that Republican ecoomic policy quadrupled the debt in the 12 years before I took office and doubled the debt in the eightyears after I left because it defied arithmetic,? he said.

The Clinton speech concluded a day of some self-inflicted wounds for Democrats. First, campaign organizers announced they were moving Obama?s address concluding the convention Thursday from an outdoor stadium to the smaller Time Warner Cable Arena because of possible thunderstorms.

Later, the Wednesday session started with some dissension when delegates approved a change in the party platform to reinstate language recognizing Jerusalem as the capital of Israel. The original platform approved on Tuesday omitted that reference, which had been part of the 2008 platform, and Republicans quickly criticized it as a snub to Israel.

Another change restored the word ?God? to the platform after the 2012 version omitted it, though it included language on faith as part of American society. The language referring to God-given rights was the same as in the 2008 platform.

It took three voice votes, with supporters and opponents of the changes strongly expressing their preference, before a clearly flummoxed Los Angeles Mayor Antonio Villaraigosa declared himself satisfied that a two-thirds majority backed the new language despite groans of dissatisfaction from some delegates.

The delegates burst into applause minutes later when Olympic gold medalist Gabby Douglas led them in the Pledge of Allegiance.

A senior Democratic source told CNN that Obama intervened to change the platform language, saying the president ?didn?t want there to be any confusion about his unshakeable commitment to the security of ? Israel.? In addition, Democratic sources said Obama also asked aloud why the word ?God? had been dropped.

CNN political contributor Paul Begala, who has served in Democratic administrations, called the platform flap ?embarrassing, stupid? and ?an unforced error by my party.? Ari Fleischer, a former White House press secretary in the George W. Bush administration who also is a CNN contributor, said the issue reflected a split among Democrats over support for Israel.

?The platform is being amended to maintain consistency with the personal views expressed by the president and in the Democratic Party platform in 2008,? said a statement by Rep. Debbie Wasserman Schultz, who heads the Democratic National Committee. ?Jerusalem is and will remain the capital of Israel. The parties have agreed that Jerusalem is a matter for final status negotiations. It should remain an undivided city accessible to people of all faiths.?

Other Democratic leaders clearly wanted to put the flap behind them.

?We repaired this platform. It shouldn?t be an issue anymore,? said Rep. Steve Israel of New York told CNN, conceding: ?It shouldn?t have happened in the first place.?

On the venue change for Thursday?s speech, Obama campaign officials said they were disappointed but called it a public safety issue. They are encouraging those scheduled to attend at the stadium to instead organize block parties in their neighborhoods.

Despite the change, campaign officials were enthusiastic about how the convention began Tuesday, with one senior official calling the program that featured powerful and at times emotional speeches by first lady Michelle Obama and others a ?fantastic, high energy night.?

CNN Senior Political Analyst David Gergen agreed that the opening night couldn?t have gone much better, adding: ?If they have two more nights like this, they could possibly break this race open.? After the platform imbroglio Wednesday, though, Gergen noted Democrats started the session ?with a stumble.?

Cheering delegates heard plentiful criticism of Romney as Democrats responded to last week?s GOP convention, which sought to frame the November vote as a referendum on Obama?s presidency amid high unemployment, sluggish economic growth and mounting federal deficits and debt.

Romney kept up the attack Wednesday, telling reporters that the nation?s $16 trillion debt level reached this week and an increase in food stamp recipients during Obama?s presidency showed the failure of his policies.

?There is just no way to square those numbers with the idea that America is doing better, because it?s not,? Romney said during a break from debate preparations in New Hampshire.

Facing a tight race and unrelenting GOP attacks that Obama has made things worse while in office, Democratic organizers planned a convention that emphasizes the tough decisions the president has made so far and the additional steps needed to bolster the middle class.

Speeches on Tuesday and Wednesday lambasted Romney and Republicans, accusing them of being out of touch and politically divisive at a time requiring national unity. Seeking to further strengthen Obama?s advantage with women, Hispanic Americans and young voters, the Democratic speakers hailed the president for promoting health care reforms, supporting gay marriage and ending deportations of some young illegal immigrants.

?Democrats trust the judgment of women. We reject the Republican assault on women?s reproductive health,? said House Democratic leader Nancy Pelosi of California. ?It?s just plain wrong. When you go to the polls, vote for women?s rights. Vote for President Obama.?

Elizabeth Warren, the consumer advocate running for a U.S. Senate seat in Massachusetts, complained that people today ?feel like the system is rigged against them.?

?They?re right, the system is rigged,? Warren said to cheers, adding that Obama was fighting to ?level that playing field.?

Sister Simone Campbell, a Catholic nun challenging the Republican budget proposal by Romney?s running mate, conservative House Budget Committee Chairman Paul Ryan of Wisconsin, said the austere plan would harm the work being done to alleviate suffering by the sick and impoverished. She called the Ryan plan an ?immoral budget ? that does not reflect our nation?s values.?

Another speaker told how he lost his job in 1994 at the Ampad paper plant taken over by Romney?s private equity firm, Bain Capital.

?I don?t think Mitt Romney is a bad man. I don?t fault him for the fact some companies win,? Randy Johnson said. ?What I fault him for is making money without a moral compass. I fault him for putting profits before people like me. But that?s just Romney economics. ? Mitt Romney will stick it to working people. Barack Obama is sticking up for working people. It?s as simple as that.?

On Tuesday, Michelle Obama offered a personal perspective on why her husband should be re-elected, telling the convention that the same values she fell in love with guide him each day in the White House.

?In the end, for Barack, these issues aren?t political, they?re personal,? she said. ?Barack knows the American dream because he?s lived it, and he wants everyone, everyone in this country to have the same opportunity, no matter who we are, or where we?re from, or what we look like, or who we love.?

Earlier, Chicago Mayor Rahm Emanuel recalled the litany of crises that greeted the Obama administration when it assumed office in January 2009: a Wall Street meltdown, economic recession, wars in Iraq and Afghanistan, a collapsing auto industry.

?Each crisis was so deep, and so dangerous, any one of them would have defined another presidency,? said Emanuel, who was Obama?s chief of staff at the time. ?We faced a once-in-a-generation moment in American history, and fortunately, we have a once-in-a-generation president.?

On Wednesday, Emanuel said he was giving up his role in Obama?s campaign to focus on fund-raising in the face of the advantage gained so far by Romney and Republicans, including super-PACs supporting him.

The Romney campaign said no amount of rhetoric could mask what spokeswoman Andrea Saul called Obama?s ?record of disappointment and failure.?

?On the first night of President Obama?s convention, not a single speaker uttered the words ?Americans are better off than they were four years ago,?? Saul said in a statement, adding that ?the American people will hold President Obama accountable for his record.?

Romney?s campaign is focused on the question of whether Obama has made life better for Americans, arguing that continued economic woes show that White House policies have failed to deliver a recovery from the recession that began during the previous Republican administration.

The ?are you better off? strategy was famously employed in 1980 by Ronald Reagan, who asked voters that question when running against the incumbent Carter at a time of national economic woes. Reagan went on to win, and the Romney campaign has repeatedly invoked his name this year while seeking to link Obama and Carter as failed leaders

The Romney campaign continued that strategy Wednesday with an appearance by Ryan in Iowa.

?We are going to hear a lot of things in Charlotte, but we are not going to hear a convincing argument that we are better off than we were four years ago,? he told told supporters in Adel.

The back-and-forth between the campaigns is part of their struggle to define the election in the minds of voters. Republicans want it to be about Obama?s presidency, while Democrats seek a choice between differing political ideologies on the size and role of government.

In particular, Republicans seek to shrink the size of government and end chronic federal deficits and rising national debt through reducing spending, reforming entitlement programs such as Social Security, Medicare and Medicaid, and slashing taxes on businesses and many individuals as a spur for economic growth.

Obama and Democrats argue that a deficit reduction plan also needs additional revenue, and they propose allowing tax rates on income of more than $250,000 for families and $200,000 for individuals to return to the higher levels of the 1990s.

Republicans oppose any kind of tax increase, and the impasse over that issue has been the main impediment to a comprehensive deficit reduction agreement during Obama?s first term.

The race overall is very tight, with a new poll Tuesday showing Romney received little bounce from last week?s convention intended to introduce him to voters just now turning their attention to the presidential race.

The CNN/ORC International Poll also indicates that less than 40% of registered voters said the GOP convention made them more likely to vote for Romney. At the same time, Romney got a slight bump in his favorable rating, and on being in touch with the middle class and women, although he still trails Obama on those two questions.

CNN?s previous poll, released as the Republican convention got under way, indicated that 49% of likely voters backed Obama, with 47% supporting Romney, a statistical tie. In the new survey, which was conducted after the GOP convention, both the president and Romney are at 48%.

?The Republican convention had at best a mild effect on the presidential race, and from a statistical viewpoint, no effect at all,? said CNN Polling Director Keating Holland.
